There is NO ACTUAL Law that says we can't travel in the UK. Just because the First Minister stands up in the Scottish Parliament and says we can't go isn't law and cannot it be enforced.

There is NO ACTUAL Law that says we can't travel in the UK.

There is. The Health Protection (Coronavirus) (Restrictions and Requirements) (Local Levels) (Scotland) Regulations 2020 which is their current law on restrictions in Scotland

(3) This paragraph is without prejudice to the restrictions in Part 4 of schedule 4 and Part 4 of schedule 5.

2.—(1) A person who lives in a place within the common travel area mentioned in paragraph 4 must not enter or remain in Scotland.

(2) But a person who does not live in Scotland may travel through Scotland in order to reach a place outwith Scotland.

Fine if you decide you want to ignore it, but let's at least get the facts right about what laws exist and what they say please.

And also the Crown Prosecution Service has stated that they are not enforceable, hence the 300 or so people taken to court for breaches of these Government Guidelines were found not guilty,

Oh dear god. Well I don't wish the thread should be drawn further down this diversion, but I bow to the extensive experience of the armchair lawyers.

@KARFA perhaps if you specialise in this field you could elaborate further?

I am a lawyer.

Statutory Instruments do not need to be signed by the Queen, the minister is given power to enact them in accordance with the Coronavirus Act 2020 which was enacted by the Queen.

Most people have been dealt with by the way of talking to, some given fixed penalties. A few have been taken to court but prosecutions have mostly foundered on the wrong sections being referenced - which is not a surprise when the law is being amended almost weekly. People have not been found not guilty because the statutory instruments are unenforceable.

Thank you @KARFA and for the benefit of others here, there are of course many different types of solicitors such as probate; family law; crime; conveyancing and each will specialise in their own chosen field often with little knowledge outside their own specialised area.

Although we are going widely off topic, the very nature of this discussion stems from the lack of communication between the devolved nations and central government. If Nicola Sturgeon says you can't come to Scotland and that becomes law, then we should be following that. But as highlighted here, it hasn't been communicated very well if people in England don't know that. I don't think we need a solicitor to draw that conclusion but indeed, thank you for offering some clarity.

Sorry KARFA I used Statutory Instruments at times in the course of my work quite often. But the other week I was looking at the Law Book I used for my exams and looked Stat.Int.s up . It turns out that they have no standing the the Law. That surprised me.

I think you have misread your book.

They certainly do with regard to Health and Safety at work!

Good news indeed, over the last three days they have done half a dozen check flights from BHX to NCL and back plus the odd spin round the block so seemingly preparations well under way.

Today they are doing one of the NCL trips with a 788.
