I don’t think it’s coincidence that LCC have decided to take enforcement action shortly after LBA announced they would appeal. Odd how a year ago such action was declared not to be in the public interest because of the costs involved and now suddenly it is. I suspect some face saving and back covering going on. Meanwhile the potholes in Leeds continue not to be repaired but hey, it’s only Council Tax payers money.
 
Seems the Clowncil have suddenly thought that they had better start taking enforcement action now. Odd they didnt for the past 10 years or more, yet do now after the CLEUD. I'm sure that will be something that will come under scrutiny when the airport's appeal is heard.
Presumably their CLEUD research has led them to believe they now have a copper bottomed case.
 
I tend to agree that this is the council now trying to save face with the group who shall not be named. I think they know they are in the doggy doo dah over all this and just have to be seen to be doing something. Ironically more than likely going to be an expensive mistake on their part. Might mean less cycle lanes to be constructed due to lack of funds. Perhaps if LBA applied for one the length of the runway this would bring the council fully inside!

The interesting thing is that according to the airports legal advice, the Council are no longer able to enforce this because they never did for over 10 years. Them now deciding to do so is effectively testing the water. I would think LBA may challenge the enforcement.

In their response on the Cleud that deals with the 10 year matter, the council established there was not a continuous 10 year period.

I would think that legally, a continuous period of ten years with sporadic breaches over that time will suffice. Short of breaching every single night then you will never have a continuous period. I hope I’m making sense….
Which if I am, would imply the airport are being punished for not breaching enough….?
 
They are plain daft. I was told a few weeks ago that LCC was over £2b in the red, so where's the money coming from?

In which case, the 300s are barred from depart outside daytime hours? If that's the case they can't depart until 0700, which would affect Jet2 ops. should the council succeed with their stupidity.

If that’s right then since the 300s are due to go in 3 years time the QC1 palaver will become academic.

The 733 is actually QC 0.5 on departure on the list shared - all other based aircraft appear to be below QC1 therefore as the 'enforcement' only mentions 'departures' it seems pointless. Whether there is some obscure strategy here (placating a minority group?) on behalf of LCC or they have simply messed up, I have no idea - but on the face of it - carry on as normal?

Carry on as normal is exactly what I expect LBA will do whatever games the council are playing.
 
The whole thing is degenerating into farce thanks to LCC who seem to have taken their ball home like a spoilt seven year old ever since LBA announced they were appealing the CLEUD decisions. As above I would expect LBA to continue as they are now using their interpretation of the restrictions and let the legalities play out.

Yes wasting money like on that pointless path there constructing up the side of the ring road between rodley and owlcoats, causing traffic misery!

according to some people, you only need 1 day in each of the Yorkshire Dales, North Wales and Lake District "to have seen it all". Which is why its minibus tour number 3 this year of the Yorkshire Dales for me on 16th October. Different routes and different things to see each tour.
